Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cue Lexington Lab Band web and mobile services (collectively, the “Service”). By creating an account, logging in, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility & Accounts

Cue Lexington Lab Band is a private communication tool for a limited group of participants (for example: musicians, sound engineers, camera operators, technical staff, and other band crew). The Service is not open to the general public. Access is granted only by an administrator of the group.

• You must be invited or approved by an administrator to create an account.
• You agree to provide accurate, current information and keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.

2. Description of the Service

The Service is designed to notify band members and related crew of important information, such as:

• Rehearsal dates, times, and locations
• Performance details and call times
• Last-minute changes, cancellations, or updates
• Logistics (equipment, sound checks, travel details, etc.)

Notifications may be delivered via in-app alerts, email, and/or SMS text messages depending on your preferences and the configuration of the Service.

You agree to use the Service only for lawful purposes and in a manner consistent with the intended use of coordinating band-related activities. You must not:

• Use the Service to send spam, threats, or harassing messages.
• Attempt to gain unauthorized access to the system or other users’ information.
• Interfere with or disrupt the security, integrity, or performance of the Service.

5. Third-Party Services

The Service may use third-party providers (such as SMS gateways, phone carriers, hosting providers, and analytics tools) to deliver notifications and operate the application. Your use of the Service constitutes your acknowledgment that these third parties may process your data solely for the purpose of providing such services.

6. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that notifications will always be delivered or delivered on time.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service;
• Any delay, failure, or error in delivering notifications;
• Unauthorized access to or use of our servers and/or any personal information stored therein.

8. Changes to the Service and Terms

We may update or modify the Service, and we may update these Terms from time to time. When we make material changes, we will update the “Last updated” date below and may provide additional notice where appropriate. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

This Privacy Policy describes how Cue Lexington Lab Band (“we,” “us,” or “our”) collects, uses, and protects information in connection with the Cue Lexington Lab Band Service. By using the Service, you agree to the collection and use of information as described in this Policy.

3. SMS Privacy & Opt-In Data

We recognize the importance of protecting your mobile number and SMS consent information. In accordance with carrier requirements:

• We collect your phone number and SMS opt-in/opt-out status solely to deliver band-related text messages and to manage your participation in the SMS program.
• We do not share, rent, or sell your SMS opt-in data or consent for marketing purposes.

Required Carrier Disclosure:
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

4. Legal Basis & Responsibility for Data

We are responsible for protecting the personal data we process through the Service and we strive to comply with applicable privacy laws. We only process your data where we have a lawful basis, such as your consent (for SMS messages), our legitimate interests in operating the Service, or compliance with a legal obligation.

5. Data Sharing

We do not sell your personal information. We may share your information with:

• Service Providers: Third-party vendors that help us operate the Service (e.g., SMS gateways, phone carriers, hosting providers, analytics, and security tools).
• Legal & Safety: When required by law or in response to valid legal requests, or to protect the rights, property, or safety of our users or others.

As noted above, SMS opt-in data and consent will not be shared with third parties for their own marketing purposes and will only be shared as necessary to provide messaging services.

We retain personal data for as long as reasonably necessary to operate the Service, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we may delete or anonymize it.

• Account Information: You may request updates or corrections to your account information by contacting us.
• SMS Opt-Out: You can opt out of SMS messages at any time by replying STOP to a message from us.
• Email / Other Notifications: You may request to change your notification preferences by contacting us.

We use reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

9. Children’s Privacy

The Service is intended for adult band members and crew. If we learn that we have collected personal information from a child in violation of applicable law, we will take steps to delete that information.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last updated” date below and may provide additional notice where appropriate. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Policy.
