By creating an account, logging in, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility & Accounts
Cue Lexington Lab Band is a private communication tool for a limited group of participants (for example: musicians, sound engineers, camera operators, technical staff, and other band crew). The Service is not open to the general public. Access is granted only by an administrator of the group.
- You must be invited or approved by an administrator to create an account.
- You agree to provide accurate, current information and keep it updated.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
2. Description of the Service
The Service is designed to notify band members and related crew of important information, such as:
- Rehearsal dates, times, and locations
- Performance details and call times
- Last-minute changes, cancellations, or updates
- Logistics (equipment, sound checks, travel details, etc.)
Notifications may be delivered via in-app alerts, email, and/or SMS text messages depending on your preferences and the configuration of the Service.
3. SMS Program Terms
SMS Program Name: Cue Lexington Lab Band
Use Case Description: When you opt in to the Cue Lexington Lab Band SMS program, you agree to receive text messages related to band activities and operations. These may include rehearsal reminders, performance details, schedule changes, logistics updates, and similar non-marketing notifications.
Message Frequency: Message frequency varies based on band activity and your role in the group.
By providing your mobile number and opting in, you consent to receive SMS messages from Cue Lexington Lab Band at the phone number you provided. Consent to receive SMS alerts is not a condition of any purchase (if any purchases are ever involved).
Help & Support: For support, contact us at mike@vandemark.pro or reply HELP to any Cue Lexington Lab Band message (if supported by your messaging provider).
Opt-Out Instructions: You can opt out of SMS messages at any time by replying STOP to a text message you receive from us. After you send STOP, we may send a confirmation SMS to verify that you have been unsubscribed. After this, you will no longer receive SMS messages from us, unless you opt in again.
Message & Data Rates: Message and data rates may apply to any messages sent to you or by you. If you have questions about your text or data plan, contact your wireless provider.

4. Acceptable Use

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that notifications will always be delivered or delivered on time.

- Any delay, failure, or error in delivering notifications;
- Unauthorized access to or use of our servers and/or any personal information stored therein.

Required Carrier Disclosure:
All the above categories exclude text messaging originator opt-in data and consent; this information
will not be shared with any third parties. We will not share your opt-in to an SMS campaign with any
third party for purposes unrelated to providing you with the services of that campaign. We may share
your Personal Data, including your SMS opt-in or consent status, with third parties that help us
provide our messaging services, including but not limited to platform providers, phone companies,
and any other vendors who assist us in the delivery of text messages.
4. Legal Basis & Responsibility for Data
We are responsible for protecting the personal data we process through the Service and we strive to comply with applicable privacy laws. We only process your data where we have a lawful basis, such as your consent (for SMS messages), our legitimate interests in operating the Service, or compliance with a legal obligation.
